Case Management Conference: Memorandum of Oral Decision by Ontario Land Tribunal

October 19, 2022

Re: Proposed 26-Storey Tower Development at Blair and Montreal Roads

The outcome of the recent Case Management Conference regarding the Developer's Appeal to the Ontario Land Tribunal (OLT) is now available in the following document:

MEMORANDUM OF ORAL DECISION DELIVERED BY BRYAN W. TUCKEY ON OCTOBER 6, 2022 AND ORDER OF THE TRIBUNAL

With the help of our legal counsel, RHPOA accomplished what it set out to do at this stage — obtain the OLT's approval for our Participant status, as well as approval to submit written comments 45 days before the OLT Hearing.

The Tribunal found that:

  • It is appropriate for the RHPOA (or any Participant) to have the opportunity to review an approved issues list found in the Procedural Orders (PO) and make necessary refinements to their previously submitted Participant Statement before the hearing.
  • A refined Participant Statement from the RHPOA is relevant and therefore admissible. The weight given this statement will be in the hands of the Member responsible to adjudicate the hearing.
  • It is a good thing that the RHPOA is taking the initiative to seek professional assistance as it illustrates how important this matter is to the association. Their commitment to understand the matter and articulate a cogent Participant Statement to assist the Tribunal is appreciated.

For more information, see the 13 page Memorandum document found at the link.

The OLT is prepared to schedule a five-day Merits Hearing commencing on Monday, April 24, 2023 at 10:00 a.m.

The RHPOA will continue its work on this file.  Thanks to the many residents who have donated in support of our fundraising efforts to date.  We’ll be in touch with additional updates as they occur.
